Terms of Service

Version v2.0 · effective 16 October 2026

Controller (Administration): Daniil Polinovskyi, natural person (private individual), Norway, Moss
Contact: [email protected]

Who the Controller is. The Controller is a natural person (a private developer), not a company. As long as paid features are not provided on an ongoing basis, the Controller does not act as a business; the corresponding provisions (Section 6.4) apply conditionally.
Applicable law. The Controller is located in Norway; this Agreement is governed by Norwegian law. For consumers in the EEA, the mandatory protective rules of the country of residence remain in force (Section 16). Data processing follows the GDPR (see the Privacy Policy).

These Terms govern the use of the MyFunction service (the website and web application on the domain myfunction.app). By creating an account and/or using the Service, the User accepts these Terms in full.

1. General provisions

1.1. These Terms are an agreement between the Controller and the User defining the conditions for using the Service: a catalog where Specialists publish profiles and Seekers find specialists and contact them.

1.2. Acceptance is registration of an account and/or actual use of the Service.

1.3. The Controller may amend these Terms (Section 15). Continued use after changes constitutes acceptance of the new version.

2. Definitions

3. Subject of the Agreement

3.1. The Controller provides the technical ability to post and find specialist profiles, exchange contacts, and browse the catalog.

3.2. The Controller is an information intermediary and is not a party to transactions between a Seeker and a Specialist. The Controller does not provide services and does not guarantee their quality, legality, or safety, nor the accuracy of Users' information.

3.3. Users enter into arrangements for work and services directly with each other and are solely responsible for them.

3.4. The Controller is not an employer, agent, or representative of Users.

4. Registration and account

5. Publishing a Specialist profile

5.1. A Specialist may publish a profile, making the data they specify (name, city, category, description, avatar, contacts, portfolio) publicly accessible on the internet.

5.2. The Specialist independently and knowingly decides what data to publish and understands that it will become available to third parties (see the Privacy Policy, Section 3.5).

5.3. A public profile is available at a permanent link myfunction.app/s/<slug>; the Specialist may unpublish it.

6. Paid features and subscription

6.1. Certain features for Specialists may be provided for a fee. As of the date of this version, paid features are not introduced; their composition, price, period, and payment procedure are published by the Controller in the Service interface before they launch.

6.2. At present, basic use is free.

6.3. Payments (once enabled) are processed by a third-party provider (Stripe); the Controller does not store card data.

6.4. Right of withdrawal (angrerett). If the Controller begins providing paid features on an ongoing basis (as a business), consumers in Norway/the EEA may have a right to withdraw from the contract within 14 days (Norwegian Angrerettloven), except for the provided exceptions. The procedure for withdrawal and refund is determined by separate payment terms and applicable law; the Controller publishes it together with the introduction of paid features. As of the date of this version, paid features are not provided, so the refund procedure does not apply.

7. User rights and obligations

The User undertakes not to:

8. Prohibited content and actions

8.1. The Controller may, without warning, remove content and restrict/block the access of a User who violates these Terms or the law.

8.2. The User bears full responsibility for their Content and the consequences of posting it.

9. User Content and license

9.1. The User retains the rights to their Content.

9.2. By posting Content, the User grants the Controller a royalty-free license to use it to the extent necessary to operate the Service: storage, processing, display in the app and on public pages, creation of previews (including OG previews), and transfer to processors.

9.3. The license is in force while the Content is posted and ends after its deletion (subject to technical timelines).

9.4. The User confirms that they hold the rights to the Content and that posting it does not infringe third-party rights.

10. Controller's intellectual property

10.1. The name "MyFunction", the design, logo, source code, and interfaces belong to the Controller and are protected by law (including the Norwegian Åndsverkloven).

10.2. The User is granted a simple (non-exclusive) license to use the Service as intended. Copying, modification, decompilation, and reworking of the Service are not permitted.

11. Disclaimer of warranties

11.1. The Service is provided "as is". The Controller does not guarantee uninterrupted and error-free operation, the safety of data during failures, or that it will meet the User's expectations.

11.2. The Controller does not verify Specialists or the accuracy of their data.

11.3. The Controller may suspend the Service for maintenance and updates.

12. Limitation of liability

12.1. To the maximum extent permitted by law, the Controller is not liable for indirect losses, lost profits, or the consequences of Users' interactions, including the quality, safety, and outcome of services.

12.2. The Controller is not liable for the actions of third parties, including processors and external services.

12.3. Nothing in these Terms limits the rights of a consumer User under mandatory rules of law.

13. Suspension and deletion of access

13.1. The Controller may suspend or delete an account in case of a violation of these Terms or the law.

13.2. The User may delete the account at any time: "Settings → Delete account". Deletion is irreversible.

13.3. The User may stop using the Service at any time.

14. Third-party services

The Service uses third-party components (authentication, hosting, anti-bot, payments). Their operation is governed by their own terms; the Controller is not liable for their failures.

15. Changes to the Terms

15.1. A new version is published at myfunction.app/legal/terms with a date.

15.2. The Controller aims to notify of material changes through the Service. Continued use constitutes acceptance.

16. Governing law and dispute resolution

16.1. These Terms are governed by Norwegian law.

16.2. For consumers in the EEA, the mandatory protective rules of the country of residence remain in force; a consumer may bring proceedings in the courts of their place of residence (including under applicable international treaties, e.g. the Lugano Convention).

16.3. Disputes are resolved through negotiation; failing agreement — before the competent court at the Controller's location (Norway), unless mandatory consumer-protection rules provide otherwise.

16.4. The invalidity of an individual provision does not affect the validity of the others.
